Italy imposed fine on Apple a $12 million for misinformation



Italy has fined Us Apple 10 million euros ($11.947 million) for misleading allegations that iPhone phones are water resistant.

The Italian National Competition Authority (AGCM) found that Apple's claims did not hold up in real-world conditions. She also said that although claims of water resistance were included in the telephone's specifications, the warranty did not include water damage, which the Authority described as aggressive practice.

Apple claimed that iPhone phones are able to withstand underwater for up to 4 meters for 30 minutes. Apple has been claiming this feature in a number of iPhone phones for several years, from the iPhone 8 to the iPhone 11, and the different models of the phones.

The Italian National Competition Authority found that Apple had not indicated that water resistance to a depth of up to 4 meters for only 30 minutes was possible under tightly controlled conditions. The FDA ruled that the announcement by Apple , which shows iPhone phones being water resistant, was misleading.

However, Apple recommends that users do not swim, shower with iPhone phones, and also say that the damage caused by liquids is not guaranteed.

The Italian National Competition Authority ruled that the lack of collateral to cover the damage caused by liquids violated sections 24 and 25 of the Consumer Act in relation to aggressive business practices, coercion or unjustified influence.

The Italian National Competition Authority objected to the fact that the warranty did not apply to something that was emphasized in the marketing campaign as an advantage. But she also said that apple's small line in the warranty could not be used to circumvent its core obligations since the product was not as claimed in the commercial.
